1. Acceptance of Terms

By accessing or using Glowup ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Glowup provides AI-powered services that generate enhanced profile photos and written content for dating applications. Our Service uses artificial intelligence to create images based on reference photos you provide, along with profile bios and prompt responses.

3. Eligibility

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

5. User Content and Photos

By uploading reference photos to our Service, you:

  • Represent that you have the right to use and authorize us to use such photos
  • Confirm that the photos are of yourself and not of any other person
  • Grant us a limited license to use such photos solely for the purpose of generating content for your use
  • Acknowledge that AI-generated images may vary from your actual appearance

6. AI-Generated Content

You understand and acknowledge that:

  • All images and content generated by our Service are created using artificial intelligence
  • AI-generated images are artistic interpretations and may not perfectly represent your actual appearance
  • Generated content may contain inaccuracies or unintended variations
  • You are solely responsible for reviewing and approving any generated content before use

7. Third-Party Platform Compliance Disclaimer

IMPORTANT: By using our Service, you expressly acknowledge and agree that:

  • Platform Terms: Third-party dating applications (including but not limited to Tinder, Bumble, Hinge, OkCupid, Match.com, and others) have their own terms of service and policies regarding the use of photos and profile content. It is YOUR sole responsibility to review and comply with these terms.
  • Photo Verification: Many dating applications employ photo verification systems to authenticate user photos. AI-generated images may not pass these verification processes. GLOWUP MAKES NO GUARANTEE THAT AI-GENERATED PHOTOS WILL PASS ANY VERIFICATION SYSTEM.
  • Account Actions: Glowup expressly disclaims any and all liability for any actions taken by third-party dating platforms, including but not limited to: account warnings, account suspensions, account bans, shadowbans, reduced visibility, or permanent termination of your account on any dating application.
  • Terms Violations: If your use of AI-generated content violates the terms of service of any third-party dating platform, YOU ASSUME ALL RESPONSIBILITY AND LIABILITY for such violations. Glowup is not responsible for any consequences arising from violations of third-party platform policies.
  • Failed Verifications: Glowup shall not be liable for any failed photo verification attempts, rejected photos, or any negative consequences resulting from the use of AI-generated photos in verification processes.
  • No Indemnification: You agree not to hold Glowup responsible for any loss, damage, or inconvenience arising from actions taken by dating platforms in response to your use of our generated content.

BY USING OUR SERVICE, YOU RELEASE GLOWUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES FROM ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, AND CAUSES OF ACTION ARISING FROM OR RELATED TO YOUR USE OF AI-GENERATED CONTENT ON THIRD-PARTY DATING PLATFORMS.

8. Payment and Refunds

All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. All sales are final. Due to the nature of AI-generated digital content, we do not offer refunds once content has been generated. Credits purchased are non-transferable and non-refundable.

9. Prohibited Uses

You agree not to:

  • Upload photos of anyone other than yourself
  • Use the Service for any illegal or unauthorized purpose
  • Create content that is defamatory, obscene, or otherwise objectionable
  • Attempt to reverse engineer or compromise the security of our Service
  • Resell, redistribute, or commercially exploit generated content
  • Use generated content for fraudulent or deceptive purposes

10. Intellectual Property

Upon payment, you receive a personal, non-exclusive license to use the AI-generated content for your personal dating profiles. Glowup retains all rights to the underlying AI technology and systems used to generate content.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOWUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Glowup and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights or terms of service.

14. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Glowup operates, without regard to its conflict of law provisions.

16. Communications

By creating an account and using our Service, you expressly consent to receive communications from Glowup, including but not limited to:

  • Transactional emails (account confirmations, password resets, purchase receipts)
  • Service-related notifications (generation completions, account updates)
  • Product updates and new feature announcements
  • Promotional offers and marketing communications
  • Tips and suggestions for improving your dating profile

You may opt out of promotional and marketing communications at any time by clicking the "unsubscribe" link in any email. However, you may not opt out of transactional or service-related communications necessary for the operation of your account.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
